All citizens of the Russian Federation who have reached the age established by current legislation can stop working. However, the economic situation in the country over the past few years has forced a significant part of pensioners to continue working. Since 2016, some changes have been made to certain aspects of the pension program (the issue of increasing the amount received) for officially employed pensioners and, according to the latest data, the government does not intend to cancel them. What will be the pension indexation after the retiree’s dismissal in 2018?

Background of the issue

Since 2015, the economy of the Russian Federation has been going through a difficult period. In order to reduce the financial burden on the federal and regional budgets, the Government of the Russian Federation decided, starting January 1, 2016, to suspend indexation for those persons of retirement age who decided to continue working. According to the increase, it does not apply to either insurance or fixed payments.

In other words, the measure introduced by the Government applies only to those citizens who receive insurance coverage regardless of the type - old age, loss of a breadwinner, disability. If a pensioner receives a state pension (this also includes a social pension), he can continue working without losing indexation.

Today, many pensioners are interested in the question of whether they will pay after leaving work. The heads of the Pension Fund and the Government recently announced that an increase for this category of citizens will be made.

Important: in the final determination of the amount of security, all indexations that were carried out during the period while the pensioner was officially working will be taken into account. But not before the “anti-crisis” measure came into force.

The amount of the accrued pension payment, taking into account all required indexations, can be found on the official Internet page of the Pension Fund, in the “Personal Account” section.

It should be noted that the insurance pension increased due to past indexations cannot be reduced even if the pensioner decides to resume working activity.

However, due to a change in status, the pensioner loses the right to subsequent indexation exactly until he stops working again.

Indexing order

It is known that pensioners who managed to quit or are just planning to stop working before the end of the current year, 2017, will be able to apply for recalculation after a sufficiently long period of time. How long after dismissal is a pensioner’s pension indexed? On average, after three months.

This is explained by a number of facts. Namely:

  • mandatory monthly reporting by the employer. According to the rules in force for 2017, enterprise managers independently report on employed employees by the 15th of the current month for the previous 30 days. Accordingly, if a pensioner quit in the month when the reports were submitted, he will be listed as an employed person for another month. And this delays the process of calculating indexation;
  • waiting for a response from the Pension Fund to information received from the employer and making a final decision;
  • rules for payment of allowances. The insurance pension, taking into account all indexations required by law, will be paid no earlier than the next month after the Pension Fund makes a decision.

How is the pension indexed after the retiree’s dismissal in 2018? The procedure for calculating the allowance increase is changing. This became possible thanks to the recent adoption of Federal Law No. 134. The document amends Part 3 of Art. 26.1 Federal Law No. 400.

From what month is the pension indexed after dismissal from work according to the changes made?

According to the press center of the Pension Fund, the increased salary will be paid from the 1st day of the month following the month of dismissal. It should be remembered that the full pension payment will be made according to this scheme. For example, the dismissal of a pensioner took place in April. The employer's reporting is received by the Pension Fund in May and indicates that the person is still in the state. Information about dismissal will be received by the Pension Fund only in June. Next month, the Pension Fund will decide to resume indexation, and in August the pensioner will be credited with the full pension amount.

As you can see, according to the new rules, the increased allowance is accrued after the same three months as under the current ones. The payment of pension indexation after dismissal in 2018 differs in that the amount includes compensation for the missed 90 days. Whereas this year this is not practiced.

Since 2016, monthly simplified reporting has been in effect in Russia. According to this document, all employers, regardless of status, are required to provide the Pension Fund with complete data on all persons from the state, as well as those who quit.

If a pensioner belongs to the category of self-employed (notary, lawyer, individual entrepreneurs), the Federal Tax Service transmits information that their employment has been terminated to the Pension Fund.

Legislatively, a citizen has the right to independently apply to the Pension Fund of the Russian Federation with an application. This will allow you to obtain information about how many months after dismissal the pension is indexed from reliable sources.

You can submit an application through the following structures:

  • territorial branches of the Pension Fund;
  • Multifunctional Center.

You can download an application form confirming the termination of work and/or other activities on the official website. There are several ways in which applications can be submitted to government agencies. Namely:

  • personal appeal;
  • through a legal representative (this person must have a notarized power of attorney);
  • using Russian Post services;
  • remotely, through your Personal Account on the official website of the Pension Fund.

It is important to remember that the method in which the application was sent does not in any way affect the speed of processing. In order for the Pension Fund to begin the procedure for calculating indexation, information from the Tax Service or the policyholder will be required. Accordingly, the independent option of filing an application does not make sense.


Pension for non-working pensioners

The pension supplement, or indexation, is carried out annually. It is necessary to maintain economic balance, which is disrupted due to changes in the exchange rate, inflation, and consumer prices.

Working pensioners do not have the option of indexation before dismissal. Those. Pensioners with work will also be given an insurance (labor) pension and a fixed payment, but without indexation. This is due to changes in payments to pensioners, which have already come into force.

The cancellation of indexation did not apply only to those who, as of September 30, 2015, were not working. If the pensioner was self-employed (was not subordinate to the employer and worked for himself, was an entrepreneur) by the end of 2015 he had to leave his job, otherwise he would become employed.

Naturally yes. After finishing the work, the data is entered into the work book, and according to it, the calculation is carried out (in this case recalculation) pensions. At the time of employment, the elderly citizen will receive a fixed pension without indexation.

After resigning, he unfreezes the suspension of recalculation, and it is summed up for the entire period of work. Simply put, it continues to accrue during the period of employment, but is not paid until termination. The rule continues to be extended as part of pension reform.

After dismissal and submission of an application with all documents to the Pension Fund, indexation will be carried out on the 4th month from the date of termination of work. For example, if a person quit on April 5 and submitted an application on April 15, then the recalculation will be performed on July 5. If the application was submitted on May 1 or later, recalculation will be carried out only on August 5. An alternative increase in pension is also possible - changing the type of payment.

Pensioners who have work experience and are supported by a social pension are recommended to change the type of pension. If you are elderly and do not have sufficient work experience, you also have the opportunity to work your way up and move to another category – labor.

Some nuances

  1. By resuming work again, your pension will not be reduced. Thus, after resigning and undergoing re-indexation, you can continue to work and receive a pension, taking into account bonuses.
  2. At the beginning of April 2018, pensions were also increased for all persons, regardless of current status, in the amount of 4%.
  3. The government is considering a law to suspend payments to employees with an annual salary of 1 million rubles or more due to a lack of funds from the state.
  4. Switching to retirement is not cost-effective. Due to the very low pension, you have to get out by getting a job or looking for money. The 14 million mark of employed retirees proves this fact.

According to statistics, there are over 14 million working pensioners in Russia, which is due to the low level of pensions, which is not easy for an ordinary citizen to live on.

Employed pensioners are included in a special category; they always receive smaller payments than non-working citizens of retirement age. And at the same time, the question of completely denying them monthly payments until they leave their jobs is regularly raised.

Will there be a recalculation of the pension payments of a pensioner who continues to work after he leaves work? Yes, modern legislation guarantees its elderly citizens after their dismissal a full indexation of their pension, the size of which will depend on the period of work before retirement, as well as on pension points, coefficients and insurance contributions.

Today we will talk about how a working citizen’s pension will be indexed, the timing of this procedure and the changes that will affect it in 2019.

Indexing order

In accordance with Russian legislation, every citizen upon reaching retirement age is considered to be working when he is officially employed, that is the employer pays monthly insurance and pension contributions for him.

Let us remember that pensioners in Russia are considered to be women over the age of 55 and men over the age of 60. If a person is over this age, he is considered to be working even if he is not working for anyone else, but:

  • is an individual entrepreneur;
  • conducts legal practice or works as a notary;
  • officially registered his tutoring activities.

The peculiarity of payments to working pensioners is that they do not undergo annual February indexation. However, if a pensioner stops working, his pension will be recalculated for the entire time he had working status. Not only will recalculation be made in relation to annual indexations, but also in relation to all pension points and coefficients depending on the amount of monthly insurance contributions from the employer (on the amount of wages).

In 2019, after dismissal, persons of retirement age do not need to notify the Pension Fund of this fact. Indexation occurs automatically based on the monthly contributions made by the employer. It is the responsibility of the organization to send data about employed and dismissed persons of retirement age.

Each pensioner will receive indexed monthly payments after termination of employment automatically; no action is required for this.

Indexation terms

The Pension Fund provides a detailed explanation of whether a person’s payments will be changed if he resigns. Until the 10th of every month the employer sends information via electronic communication channels to the Pension Fund about pensioners who worked for him last month.

A person is considered to be working even if he worked only 1 day in the reporting month. If he is not on the list of employees, the Pension Fund will initiate a recalculation procedure.

Full indexation after dismissal now takes a long time, over 3 months.

As an example:

  1. In January, a person quits his job;
  2. In February, the Pension Fund receives a report from his employer stating that in January he was still working (there were insurance contributions);
  3. In March, the Pension Fund already sees that the person is not on the list - which means he has become unemployed;
  4. During April, a decision will be made to re-index his pension and all the necessary calculations will be made;
  5. And only in May a person will receive an increased, fully indexed pension.

This procedure operates in accordance with the norms of Federal Law No. 385 of December 29, 2015. The undoubted disadvantage of this procedure is that for the months that have passed since the dismissal, during which the information was received by the Pension Fund and processed there, compensation will not be paid.

Despite his actual status as an unemployed pensioner, a person is forced to receive reduced payments for 3-4 months.

Working citizens who have already had a recalculation made after leaving work can be officially employed again, and their pension will not be reduced again (but will not be indexed in the future, during the entire period of work).

Important! If information about the dismissal was not sent to the Pension Fund in due time, then the appropriate punishment will be applied to the employer. However, the pensioner should not expect compensation in this case; this is not provided for by law!

Law changes in 2019

From January 1, 2019, indexation of retirement age for retired citizens will occur immediately, from the 1st day of the month following the month of dismissal.

The re-indexing procedure, as before, will take more than 3 months, but this entire period is fully compensated. Let's look at the example again:

  1. In March 2019, the citizen resigned;
  2. In April, the Pension Fund will receive a report from the employer that the person is still among the organization’s employees;
  3. In May, the Pension Fund will see in the report that the person is no longer working;
  4. In June, payments will be indexed;
  5. And only in July will the citizen be paid an indexed pension, and in addition to it, compensation (the monetary difference between the previous and current amount of payments) for the previous 3 months - April, May, June.

Currently, the State Duma is discussing a draft law on the denial of pension payments to working pensioners whose annual income from work exceeds 1 million rubles. This is due to the lack of funds from the state.

The question of indexing payments to persons who are employed in seasonal part-time jobs and to those who independently declare their income (for example, royalties or patents) remains open. The issue of indexing payments to pensioners engaged in entrepreneurial activities is also not clearly regulated.

Working pensioners know that under the current moratorium, their pensions are not indexed. But if a person stops working, then the insurance pension begins to be indexed on a general basis. Is a pensioner allowed to resign, receive a monthly increase in pension due to indexation, and get a job again? Let's talk about it.

Restriction on indexation for working pensioners

For working pensioners, the size of the fixed payment to the insurance pension is not indexed and the cost of the individual pension coefficient is not adjusted. But if a pensioner resigns, he will receive the amount of the insurance pension and a fixed payment to it, taking into account the indexation and adjustment that took place during the period of his work, starting from the 1st day of the month following the month of termination of work.

Here is how the Pension Fund of the Russian Federation comments on the procedure for indexing pensions after dismissal:

From January 2018, after a pensioner stops working, the full pension, taking into account all indexations, will be paid for the period from the 1st day of the month after dismissal.

Payment of the full pension amount will be implemented as follows. For example, a pensioner quit his job in March. In April, the Pension Fund will receive reports from the employer indicating that the pensioner is still listed as working. In May, the Pension Fund will receive reports in which the pensioner is no longer listed as working. In June, the Pension Fund of the Russian Federation will decide to resume indexation and in July the pensioner will receive the full pension amount, as well as the monetary difference between the previous and new pension amounts for the previous three months - April, May, June. That is, the pensioner will begin to receive the full pension the same three months after dismissal, but these three months will be compensated to him.

What to do

If a pensioner quits his job, his pension will be increased - all indexations will be taken into account. At the same time, there is no prohibition in the legislation on new employment after pension indexation. Moreover, you can get a job again with the same employer (this is not prohibited). Thus, it turns out that the pensioner has the right:

  • quit your job;
  • receive an indexed pension;
  • get a job again.

However, pay attention to an important detail: in order for the Pension Fund to index the pension according to reporting documents from employers, the person must be unemployed. It takes up to three months to obtain all this data. Therefore, during this period (3 months) there is no point in getting a job. After all, if you quit and, for example, get a job again a week later, then “in the eyes” of the Pension Fund of Russia the person will continue to be listed as employed. And then there will be no indexing.

Important: after re-employment, the person will continue to receive an increased pension. Pension Fund units have no right to reduce pensions.

Many people, having reached retirement age, wish to remain in their previous position. Reaching retirement age (for men 60 years old, for women 55, with the exception of ) is not at all a reason for dismissal at the initiative of the employer, a reduction in salary or working hours. In addition, dismissal on such grounds is a violation of the principles of labor law.

According to the Labor Code of the Russian Federation, the rights and obligations of any other employee are the same. However, an employee can terminate the employment contract at his own request due to retirement. He must inform the director of the organization about this a couple of weeks in advance. The pension will be calculated in accordance with the accepted rules for calculating pension benefits.

Pension increase

Due to rising inflation, every year the government revises the indexation of pension payments and increases cash subsidies to pensioners, taking into account the situation in the Russian economy. The basis for conversion is the average wage rate in Russia.

The basic rules of indexation in the country have not changed:

  • Every year, insurance pensions are increased at the beginning of February;
  • In April, social pensions are adjusted based on the inflation rate.

At the same time, social payments increase to a greater extent than insurance payments, by an average of 3%. Over the past five years, the social block has been increased by 10.3 - 14.1%, the insurance one - by 6.3 - 11.4%. You should not expect a significant increase in pensions.

The Russian government has planned two stages for the coming year. At the beginning of February, insurance payments for disabled pensioners will be increased by 4%. Social payments will be indexed only at the beginning of April by the amount of actual inflation, for all pensioners without exception.

In 2016, indexation will not affect pensioners who have working status and are registered with the Pension Fund. They will receive only the insurance part of the pension without recalculation. Their pension will be fixed at the current level.

If a citizen of retirement age decides to resign, the amount of payments must certainly be revised. The April pension increase will still affect working pensioners.

Next year, the Government also plans to increase the pensions of disabled citizens by four hundred to six hundred rubles.

Indexation of pensions for pensioners after dismissal

As soon as a working pensioner wishes to take a long-awaited vacation from his permanent place of work, the entire pension will be accrued to him in full, taking into account all previous increases according to the general rules provided for by the legislation of the Russian Federation. Pensioners will receive all missed indexations immediately, bringing payments to the required level. That is, the pension will immediately increase by the entire indexation missed earlier.

It is planned to recalculate pensions twice in the coming year:

The first stage is an increase of 7.5%. It will affect both blocks of pensions – social and insurance. The payment will be fixed at 4,386.59 rubles for age pensioners. For disabled people of group I and citizens over 80 years of age, the payment will be 8767.19 rubles. Therefore, the average size of the insurance pension from February 1, 2016 will increase by almost five hundred rubles and will amount to 12,603 ​​rubles.

The second stage of indexation will take place in early April. Usually it is lower than the first; the increase can only affect the insurance part of the pension. But this is just a guess.

It all depends on the specific state of affairs in the domestic economy and the level of current inflation.

Pensions for working pensioners will be indexed only after leaving work. Indexation is “frozen” for the period the pensioner works. The new amount will be issued from the moment of termination of the employment contract. No compensation will be paid for previous years of service.

How to deal with pension points? Each working pensioner’s personal account with the Pension Fund reflects their pension points. Their maximum number is 10.

An increase in points for a working pensioner occurs due to monthly contributions from the employer. If you refuse to receive a pension for some time, the number of points increases to the maximum value. The number of these points is taken into account when assigning a new pension.

Who should be classified as working pensioners:

  • All pensioners who work and for whom insurance premiums are paid by employers;
  • Elderly people registered with the Pension Fund as entrepreneurs, persons providing legal services, lawyers, notaries, etc.

New pension legislation is causing unrest in society. Numerous questions arise which no one can answer yet:

  • What about seasonal part-time jobs for retirees?
  • How to control self-declared income - royalties, patents?
  • What about retired entrepreneurs?

So far, these questions have received very contradictory answers.

How is sick leave paid after the end of your working career? What are the conditions for receiving payments?

  • Sick leave is paid only for a month from the date of termination of employment obligations;
  • The employer pays only the first three days of sick leave. The rest of the payment falls on the budget of the social insurance fund of the Russian Federation. It was there that the employer made monthly contributions;
  • You must apply for payment within six months after the date of dismissal;
  • Sick leave is paid only to those pensioners who have not yet found a new job;
  • Only the certificate of incapacity for work, which is issued for the dismissed employee, is paid. Sick leave for caring for a child or elderly relative is not paid;
  • An employee who is registered with the employment service can also count on receiving payments.
