– monthly allowance for children of military personnel and employees of certain federal executive authorities who died (deceased, declared dead, declared missing) while performing military service duties (official duties), and children of persons who died as a result of a military injury after dismissal from military service from February 1 2016 will be 3176 rubles 25 kopecks (Federal Law of June 4, 2011 No. 128-FZ).

According to Article 45 of the Law of the Russian Federation of February 12, 1993 No. 4468-1, the minimum amount of pensions, pension supplements, increases and increases in pensions for certain categories of pensioners of the Ministry of Internal Affairs of Russia is determined from the calculated pension amount of 4959 rubles 85 kopecks.

– a certificate from the Federal Tax Service Inspectorate stating that the pensioner is not an individual entrepreneur (in the future it will be provided once a year);

– a certificate from the Pension Fund Office at the place of residence that a pension for the child has not been assigned and is not paid (in the future it will be provided once a year);

– an extract from the personal account of the insured person from the Pension Fund of the Russian Federation (further provided once a year);

– for children over 18 years old - a certificate from the place of study indicating the form and period of study (later provided on March 1 and September 1).

2.2. Fare payment

In accordance with the Federal Law of July 19, 2011 247-FZ “On social guarantees for employees of the internal affairs bodies of the Russian Federation and amendments to certain legislative acts of the Russian Federation” (hereinafter referred to as the Law), a citizen of the Russian Federation dismissed from service in the internal affairs bodies, having service experience in the internal affairs bodies of 20 years or more (including in preferential terms) and one member of his family is provided with payment of monetary compensation for expenses associated with the payment of travel to a sanatorium-resort organization of the federal executive body in the field of internal affairs and back (one time in year).

Thus, the article clearly defines the event in connection with which the right to reimbursement of travel expenses arises - this is a visit to a sanatorium or health resort. For other purposes (visiting relatives, friends, vacations in other organizations, etc.), the legislation does not provide for travel reimbursement.

When going to the specified institutions, the pensioner is issued a voucher, which indicates the duration of stay.

During the period of validity of the voucher, the sanatorium-resort or health-improving institution has obligations to the pensioner for his sanatorium-resort treatment or health improvement, which end upon the expiration of the voucher's validity period.

Since the Law of July 19, 2011 No. 247-FZ states that reimbursement of travel expenses is carried out when traveling to and from sanatorium-resort institutions, travel documents must be purchased in relation to the validity dates of the voucher.

If it is impossible to purchase return travel tickets for timely departure from the institution, in accordance with Article 314 of the Civil Code of the Russian Federation, seven days is considered a reasonable period for fulfilling the obligation.

Considering that G. was in the Federal State Institution “Sanatorium “Primorye” of the Ministry of Internal Affairs of Russia” on a voucher with a period of stay from November 9, 2014 to November 29, 2014, we believe that there are no grounds for reimbursement of expenses for travel made in 2015.

To reimburse travel expenses to sanatorium-resort and health-improving institutions, you must provide the following documents:

1. statement;

2. ticket stub (original);

3. receipt of payment for the trip (to a departmental institution);

4. certificate of stay in a sanatorium or rest home, in a medical institution, signed by the head and certified by the seal of the organization (institution);

5. documents related to travel (railway transport, air transport, water transport, road transport, public transport) - ticket, electronic ticket, itinerary receipt, boarding passes, cash receipt (receipt) for payment of tickets;

6. An extract from the personal bank account of the pensioner or his spouse (if paying by bank card). In the case of purchasing travel documents using a third party’s bank card, official confirmation of reimbursement of expenses by the pensioner to this third party is required;

7. in case of deviation from the direct route (transfer) - fare payment is carried out on the basis of a certificate of the availability and cost of direct non-stop travel within the relevant travel category or of its absence.

When paying for travel, a family member is additionally provided with the following documents:

8. original or certified copy in the personnel department at the former place of service of a marriage certificate (or birth certificate of a child);

9. a certificate from the child’s place of study (for persons from 18 to 23 years old) for full-time education.

When paying for travel by personal car, the following documents are additionally provided:

10. copy of driver's license;

11. copy of the MTPL policy;

12. vehicle passport;

13. vehicle registration certificate;

14. technical characteristics of the vehicle;

15. document confirming the actual distance along the route;

16. copy of the vehicle purchase and sale agreement (for an unregistered vehicle);

17. documents confirming the purchase of fuel along the route (cash receipt, when paying by bank card - personal account statement, other documents confirming actual expenses).

Copies must be certified by a notary, either in the personnel department at the place of residence, or in the pension service department at a personal reception during reception hours: Monday, Wednesday, Friday from 09.00 to 17.00, lunch break from 12.30 to 14.00.

In accordance with the above resolution, monetary compensation for travel is paid in the amount of actual expenses incurred, but not higher than the cost of travel on a direct non-stop route, and in the absence of such a route - with the least number of transfers.

In accordance with Article 20 of the above Law, if employees and citizens of the Russian Federation dismissed from service in the internal affairs bodies, as well as members of their families, have the right to the same social guarantee on several grounds, they are provided with a social guarantee on one of the grounds according to their choice.

All received applications for financial assistance are sent for consideration to the head of the OPO Central Federal District of the Ministry of Internal Affairs of Russia for the Khanty-Mansiysk Autonomous Okrug - Ugra.

2.5. Funeral benefit.

2.7. Reimbursement of funds for the production of monuments.

Another innovation concerns working pensioners. This year, this category of citizens was left without indexation, which will continue in 2017. In addition, an increase in the retirement age for civil servants will begin next year. Every year this figure will increase by 6 months.

It is worth noting that the regulatory framework in this area has changed significantly in recent years. Therefore, let us consider the procedure for calculating the amount of pension provision that is used today in more detail.

Calculation of the pension of an employee of the Ministry of Internal Affairs

And so, as we found out, every civil servant from the internal affairs system has the right to financial assistance after going on vacation due to length of service or reaching retirement age. Over the past year, the calculation of the benefit amount has increased due to the increase in the material needs of society as a whole. Today, according to the general system, the monthly payment should be 58% of a citizen’s salary. Moreover, this provision applies not only to those citizens who went on vacation in 2015, but also to all those who received a pension earlier. That is, the old system must be recalculated in a new way, and accordingly the amount of the benefit will be increased.

The preferential pension for employees of the Ministry of Internal Affairs directly depends on certain factors. All of them are taken into account in the calculation and in accordance with such indicators, the amount of financial support is established. And so, today to calculate the amount of the benefit the following data will be needed:

  • salary. In this case, we mean the amount of monthly earnings;
  • experience. The number of years that a citizen has worked in internal affairs bodies is taken into account;
  • rank. The key remains the title with which the employee entered his legal rest;
  • class qualification. There is a special classification system according to which each group is assigned certain percentages;
  • allowance. In such a situation, additions are made in relation to length of service.

In this case, the first and last points for calculation are summed up. The rest, in accordance with the tabular data, are converted into certain percentages. In this case, the formula for calculating the pension of an employee of the Ministry of Internal Affairs will look like this:

SPP = (NW + VP) * 58% * RP, where:

  • SPP – amount of pension benefit,
  • SZ – cash allowance. It consists directly of the salary and rank itself;
  • VP – longevity percentage;
  • RP – the amount of pension provision depending on length of service.

Each of these points has its own nuances. So, for example, if we consider the length of service, it has several relationships depending on exactly how many years the citizen has worked in the public service. So:

  • 2 – 5 years – 10%;
  • 5 – 10 years – 15%;
  • 10 – 15 years – 20%;
  • 20 – 25 years – 30%.

58% is a stable figure for 2015. So, four years ago, legislators decided that this percentage should increase annually, so every year it increases by 2%.

The amount of pension benefits may also vary depending on each individual situation. So, in this case, it is worth taking into account the number of years that a citizen has worked in public service. If the length of service is less than 20 years, inclusive of this figure, then you need to take exactly half of the salary. With each subsequent year of experience, this number increases by 3%. But, there is a limit on the upper indicator. So, at 85% the increase ends regardless of length of service. This is the maximum threshold that can be used.

Now let’s look at the size of the pension of an employee of the Ministry of Internal Affairs using an example. To do this, we will designate the necessary indicators and try to independently calculate the amount of the benefit.

And so, the retirement of an employee of the Ministry of Internal Affairs is characterized by the following data: his length of service is 23 years, his official salary is 13,000 rubles, he is entitled to 9,000 rubles for his rank, and the amount of the bonus is 6,400 rubles.

First of all, let’s sum up the total amount of the income part:

13,000 rubles + 9,000 rubles + 6,400 rubles = 28,400 rubles

Now multiply by percentages:

28,400 rubles * 58% * 56% = 9,225 rubles.

It is in the amount of 9,225 rubles that the pension of an employee of the Ministry of Internal Affairs will be calculated.
